You have land with development potential. You receive an offer. Then the buyer asks for a reduction because of the new Building Safety Levy.

Is the deduction reasonable—and are you still getting the best price?

England’s Building Safety Levy, introduced on 1 October 2026, adds a cost to qualifying residential developments. Although the developer normally pays it, landowners could feel the impact through lower offers.

Could your site be affected?

The levy generally applies to developments providing 10 or more new homes, subject to exemptions. The threshold concerns the number of homes, rather than the acreage of your land.

Standalone developments of fewer than ten new homes are generally exempt from payment, but smaller phases of a larger qualifying development can still be charged. Existing planning permission alone does not secure exemption: the timing of the relevant building control submission matters.

What could it cost you?

Imagine your land could accommodate 20 new homes, each with 100m² of chargeable floorspace.

Using an indicative levy rate of £30 per m²:

20 homes × 100m² × £30 = £60,000

If a developer’s maximum land budget was £1 million before the levy, this additional cost could reduce the amount available to £940,000, assuming everything else remained unchanged.

That could mean £60,000 less for you as the landowner.

This example is illustrative. Actual charges depend on the applicable rate, chargeable floorspace, discounts and exemptions. Your land’s value will not automatically fall by that amount.

A new cost should not mean an unquestioned price reduction

Developers calculate their land budgets by deducting development costs and required profit from the expected value of the completed homes. The levy adds another cost—but any reduction should be supported by clear figures.

Before agreeing, ask:

  • Has the buyer used the correct rate and chargeable floorspace?
  • Have relevant discounts and exemptions been considered?
  • Was the levy already included in the original offer?

How UK Land Consultancy can help?

You do not have to negotiate these questions alone.

At UK Land Consultancy, we help landowners review offers, question proposed deductions and compare the price alongside planning conditions, timescales and sale terms.

We can also explore suitable development options and introduce your site to relevant buyers, creating competition where possible.

Received a lower offer or been asked to accept a reduction? Speak to UK Land Consultancy before agreeing terms.

Understand the figures. Assess your options. Negotiate with confidence.
